1.Eligibility: The Totino's Instant Win Game" ("Promotion") is open to legal residents of the 50 United States and the District of Columbia, 18 years or older at time of registration and have internet access and a valid e-mail address prior to the start of the Promotion. Employees and their immediate families (spouses, parents, children, and siblings and their respective spouses) and those living in the same household of General Mills Sales, Inc, ("Sponsor"), Leader Enterprises Inc. and each of their respective parent companies, subsidiaries, affiliates, distributors, officers, directors, governors, related entities, partners, partnerships, principals, agents, licensees, sponsors, representatives, successors and assigns, and advertising/promotion agencies (collectively "Released Parties") are not eligible to play, enter, or win. Promotion subject to applicable federal, state, and local laws and regulations. Void where prohibited by law. Promotion begins at 12:00:00 a.m. Eastern Standard Time ("EST") on 2/12/12 and ends at 11:59:59 p.m. EST on 2/29/12 ("Promotion Period") and consists of registration and an interactive Instant Win Game ("Game").
2.How to Play: To Register and Play Instant Win Game: Visit www.get-behind-the-wheel.com (the "Site"), and complete and submit registration form during Promotion Period per onscreen instructions provided. Limit (1) registration form submission per person, regardless of the number of e-mail addresses used, during Promotion Period. Additional registration forms received from any person will be void. After registering, click the "Play" button and play the Game ("Game Play") in its entirety during Promotion Period per instructions provided. Each time you visit the Site to play the Game during the Promotion Period ("return visit"), enter your e-mail address and phone number supplied during initial registration and click "Play Again" button. Flash 10 Plug-in must be installed on your computer to play and can be downloaded for free at http://www.adobe.com.
3.Conditions of Entry: Limit (1) Game Play per person per day, regardless of the number of e-mail addresses used, during each day of the Promotion Period (with a day defined hereafter as the 24-hour period beginning at 12:00:00 a.m. EST and ending at 11:59:59 p.m. EST. Additional Game Play attempts from any person during any (1) day of the Promotion will be void. Game is not skill-based. If you click the "Play" button at a randomly selected winning time (as predetermined by Sponsor) or if no one clicks "Play" at such time and you are the first to play thereafter (as determined by Sponsor), you are a potential Instant Prize winner. If you are a potential Instant Prize winner (prize to be award subject to verification of eligibility, winning Game Play verification and compliance with Official Rules terms), you will receive a winning message indicating that you are eligible to win and you will be prompted to verify your contact information by completing the prize claim redemption form. Prize claim redemption form must be completed and returned upon receiving on-screen request or prize will be forfeited and may be awarded in the 2nd Chance Drawing described below as determined by Sponsor. Prize claim redemption form subject to claim verification. All material submitted in connection with this Promotion becomes the sole property of Sponsor. Incomplete prize claim redemption form submissions will not be processed. If you enter and are not a winner, you will receive a message indicating that you have not won and can try again the next day if the Promotion Period is still active. Your submission of a registration form, Game Play, and/or prize claim redemption form (collectively "Promotion Data") constitutes your consent to participate in this Promotion and your consent for Sponsor to obtain, use, and transfer your name, address and other information for the purpose of administering this Promotion. Winners participation in this Instant Win Game constitutes winners' consent for Released Parties and their designees and assigns to use winner's name, voice, city/state of residence, biographical information, photograph and/or likeness, and entry for advertising and promotional and/or trade purposes, in any media or format, online or offline, now or hereafter known without further compensation, permission, or notification, unless prohibited by law. Released Parties are not responsible for late, lost, stolen, misdirected, delayed, inaccurate, incorrect or undelivered Promotion Data; any error, omission, interruption in service due to system upgrades, repairs, modifications or other causes, defect or delay in transmission or communication; telephonic, human or computer failures, problems or errors; theft, destruction or unauthorized access to, or alteration of, Promotion Data; technical or mechanical malfunctions, or other malfunctions or errors relating to or in connection with the Promotion, including, without limitation, errors which may occur in connection with the offering of the Promotion, the administration of the Promotion, the processing of Promotion Data, or with prize announcements; interrupted or unavailable network, server or other connections; Internet traffic congestion or any technical problem, including but not limited to any injury or damage to entrant's or any other person's computer related to or resulting from Promotion participation; errors or omissions in Official Rules, in any Promotion-related advertisements or other materials; human-processing error; failures of electronic equipment, computer hardware or software; or inaccurate entry information, whether caused by equipment, programming used in this Promotion, human error, or otherwise. Sponsor reserves the right, in its sole discretion, to void any and all entries of an entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness, or proper play of this Promotion and to cancel, terminate, modify or suspend the Promotion. Sponsor reserves the right to select winners in a random drawing from among eligible and non-suspect registration submission received as of date of early termination. CAUTION: Any attempt to deliberately damage any Web site or undermine the legitimate operation of this Promotion is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages and/or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law. In the event the number of Instant Win messages issued exceeds the number of Instant Win Prizes listed in these Official Rules, Sponsor reserves the right to conduct a random drawing from among all eligible, non-suspect and valid Instant Win message prize claimants to award the listed number of Instant Win prizes. Only the published number of Instant Win Prizes stated in these Official Rules will be awarded. In no event will Sponsor be obligated to award more than the number of prizes stated herein. Instant Win Prize winners will be notified by e-mail following being determined that they are a winner. Prizes will be awarded to the person named on applicable registration form (regardless of whether that is the name of the authorized account holder of the e-mail address from which said registration form was submitted) subject to verification of eligibility and compliance with Official Rules. In the event that a potential Instant Win Prize winner is disqualified for any reason, that prize may be awarded in a 2nd Chance Drawing (see below) at Sponsor's sole discretion.
4.Prize/Value/Odds of Winning: Limit One (1) Instant Win Prize per person, immediate family or household. There will be one (1) Instant Win each day during the Promotion Period. Prizes: Each daily Instant Winner (subject to verification) will be awarded a $100 Kroger gift card to be used exclusively at a Kroger store. Gift card is subject to certain terms and conditions as specified by issuers. There will be a total of eighteen (18) Instant Win Prizes. Total ARV of all prizes: $1,800. Federal, state, and local taxes and all other expenses not specified herein are solely the winners' responsibility. Odds of winning an Instant Win Prize will depend on exact date and corresponding time of your Game Play across all players as it relates to each Instant Win Prize.
5.2nd Chance Drawing: If necessary to award any unclaimed instant win prizes, a 2nd Chance Drawing will be conducted by Leader on or about 3/9/2012 from among all registrants to award any unclaimed Instant Win Prizes. Odds of winning 2nd Chance Drawing depend on total number of eligible registrants and total number of unclaimed Instant Win Prizes. 2nd Chance winners (if any) will be notified by e-mail.
6.Prize Conditions: No transfer, assignment, cash redemption, or substitution of prize (or portion thereof) except by Sponsor in its sole discretion due to prize unavailability, and then for a prize (or applicable portion thereof) of equal or greater value. Potential winners may be required to sign and return an Affidavit of Eligibility, a Liability Release and where legally permission, a Publicity Release within 7 days of first attempted notification. Failure to comply with this deadline may result in forfeiture of the prize. By participating, entrants agree to be bound by these Official Rules.
7.RELEASE: By participating in or accepting a prize, the entrants and winners agree to release and hold harmless the Released Parties, their parents, affiliates, subsidiaries, advertising and promotion agencies, and each of their respective directors, officers, employees, representatives, agents, successors and assigns from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the prize, or participation in the Promotion.
8.Disputes. Except where prohibited, by participating, Participant agrees that any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court of Minnesota; any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Minnesota without giving effect to any choice of law or conflict of law rules (whether of the State of Minnesota or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota.
9.Participant's Personally Identifiable Information. Information collected from Participants is subject to Sponsor's Privacy Policy at: http://www.generalmills.com/corporate/privacy/privacy.aspx.
10.Winner List. For a copy of a winner list, send a self addressed stamped envelope to "Totino's Sweepstakes" c/o Leader Enterprises, 1775 Woodstock Road Suite 200, Roswell, GA 30075 to be received prior to 3/20/2012. Official Rules will be made available for 30 days following the end of the Sweepstakes at www.get-behind-the-wheel.com.
